التدرج في سن الحدث الموقوف للنظر في التشريع الجزائري
Résumé: يتحدد سن بداية توقيف الحدث للنظر بلحظة إرتكابه للجرم أو محاولة إرتكابه له، والتي حددها المشرع الجزائري بسن تمام الثالثة عشرة سنة، والتي يتدرج تطبيق إجراء التوقيف للنظر فيها وفقا للتدرج في المراحل العمرية للحدث، آخذا بعين الإعتبار لعنصر بداية القدرة على التمييز والإدراك لديه، زيادة على مجموعة من الضمانات التي وفرها له قانون الطفل الجزائري رقم 15-12 المؤرخ في 15 يوليو 2015 فيما يخص توقيفه للنظر، وهي ضمانات مكرسة في جميع مراحله العمرية وقبل تمامه سن الثامنة عشرة سنة، والتي راعى فيها دائما صغر سنه، الذي يتطلب نوع من المعاملة الإصلاحية والتربوية، بدلا من المعاملة الزجرية.The age of the beginning of the arrest of the juvenile for consideration is determined at the moment of the commission of the offense or the attempt to commit it, which was determined by the Algerian legislator at the age of thirteen years.
