Résumé: الملخص: لا يختلف اثنان في أن الأسرة هي الخلية الأولى لكل مجتمع مهما تنوعت سياساته وتفرقت اعتقاداته، لذلك حاولت التشريعات وضع أحكام تضبط توازنها واستقرارها، لأن في استقرارها وتوازنها تحديد لمعالم المجتمع المتكون أصلا من مجموعة أسر. فالأسرة نظام ديني ومؤسساتي ، يقوم أول ما يقوم على ارتباط رجل بامرأة في علاقة زواج نظمتها التشريعات حسب وضعيتها الاجتماعية و أسسها القانونية وانتماءاتها الدينية، وفي الشريعة الإسلامية عرف الزواج بالميثاق الغليظ وهو بهذا الوصف يدل على قوته وعظمه ، قال الله تعالى " وكيف تأخذونه وقد أفضى بعضكم إلى بعض وأخذن منكم ميثاقا غليظا" سورة النساء الآية 2. إلا أن هذه الوضعية المقدسة قد تعتريها مشاكل متعددة تزعزع كان الأسرة وتودي إلى شرخ العلاقة الودية المبنية على المعاشرة بالمعروف وتتحول إلى انحلال الرابطة الزوجية منتجة تبعات أهمها أحقية الحاضنة بمسكن لإيواء المحضون. سواء بسبب الزوج أو الزوجة أين تصبح العلاقة مصدرا للشقاق والخصام بينهما فتتحول العلاقة الهادئة إلى جحيم لا يطاق، لذا شرع الطلاق لحل هذه الرابطة باعتبار أنه لا يمكن للزوجين المعاشرة بالمعروف أو القيام بالواجبات الزوجية على أكمل وجه وهذا ما يؤدي إلى إثارة مشاكل عديدة بعد فك الرابطة الزوجية ومن بينها مسألة الحضانة والنفقة والمسكن، ويعتبر هذا الأخير من أهم المشاكل التي يصعب حلّها.
