الوكيل الإلكتروني الذكي دراسة للأطر التشريعية والإشكالات القانونية

Résumé: الوكيل الالكتروني الذكي هو برنامج يستعمل في إبرام عقود التجارة الالكترونية، حاولت مختلف التشريعات الدولية والوطنية دمج مفهومه التقني ضمن أطر قانونية سعت على اختلافها إلى صياغة مفهوم يعبر عن خصوصية الوكيل الالكتروني الذكي ،وتحديد نطاق المعاملات الإلكترونية بوجه عام ونطاق تعاملات الوكيل الإلكتروني الذكي بوجه خاص غير أن التعاقد بواسطة هذه الأنظمة الذكية يثير مجموعة من الإشكالات القانونية المتعلقة بشروط صحة الرضا أو المسؤولية القانونية لذا فإن الفقه القانوني حاول وضع قواعد مكملة لمن أجل منح الثقة والحماية للمستهلك الإلكتروني في التعاملات التي تكون بواسطة الوكيل الإلكتروني الذكي. The Smart Digital Agent is a program used in the conclusion of e-commerce contracts. Various international and national legislations have attempted to integrate its technical concept within legal frameworks, striving, despite their differences, to formulate a concept that reflects the uniqueness of the smart digital agent, and to define the scope of electronic transactions in general and the scope of transactions involving the smart digital agent in particular. However, contracting through these smart systems raises a number of legal issues related to the conditions for the validity of consent or legal liability. Therefore, legal scholars have attempted to establish supplementary rules to provide trust and protection for the electronic consumer in transactions conducted through the smart digital agent
