الوكيل الالكتروني و تحقيق التعاقد الآمن

Résumé: يعد التعاقد عن طريق الوكيل الإلكتروني من أهم المستجدات التي جاءت بها قواعد التجارة الإلكترونية الوطنية والدولية، حيث ساهم الوكيل الإلكتروني في تسهيل عملية إبرام عقود التجارة الإلكترونية وانتشارها. فبفضله أصبح من الممكن إبرام العقد بين الانسان والجهاز الالكتروني أو بين جهازين، بصورة سريعة ودقيقة وفق برمجة مسبقة، وإنّ ابرام العقد التجاري الالكتروني في ظل البيئة الرقمية ودون تدخل مباشر للعنصر البشري هو التحدي الذي يواجه التعاقد عن طريق الوكيل الالكتروني، ويفرض عليه مجموعة من المقتضيات سعيا لتحقيق التعاقد الآمن، مما يرتب مسؤوليته عند الاخلال بها، وهو ما سنتناوله من خلال بحثنا بعد بيان مفهوم الوكيل الإلكتروني وطبيعته القانونية.
