إشتراط عمل المرأة في عقد الزواج - دراسة مقارنة بين الشريعة و القانون -

Résumé: تناولت الدراسة موضوع اشتراط عمل المرأة في عقد الزواج، و هو نوع من أنواع الشروط التي تشترطها المرأة لتضمن به حقها في العمل، و لقد أثار هذا النوع من الشروط جدلا فقهيا واسعا تمحور أساسا حول مدى مشروعية عمل المرأة فمنهم من منع عنها العمل و جعل الأساس في وظيفة المرأة هو إدارة بيتها و رعاية أسرتها، بينما أجازه البعض بقيود أهمها إذن الزوج بالعمل. كما اختلفوا حول حكم هذا الشرط و مدى تأثيره على عقد الزواج. أما المشرع الجزائري فقد تبنى موقف المجيزين لهذا الشرط و سمح من خلال نص المادة 19 من قانون الأسرة المعدلة بموجب الأمر رقم 05/02 للمرأة أن تمارس حقها في الاشتراط ، و منها اشتراط العمل و ألزم الزوج بضرورة الوفاء بهذا الشرط تطبيقا للنصوص الشرعية التي تدعوا إلى الوفاء بالعهود ، و رتب على مخالفته لهذا الشرط جزاء يتمثل في حق المرأة في التطليق لمخالفة الشرط والتعويض في حالة الضرر . : Abstract The study addressed the stipulation of the wife' work in the marriage certificate, which is one of the condition that the wife stipulates to guarantee her right to work This condition sparked a wide religious debate that focused primarily on the legitimacy of the wife' work .Some have banned her work and have said that the wife' main task is to manage her home and support her family, while others have authorized it with restrictions ,in particular the . husband' authorization . In addition, they disagreed on the charia view on this stipulation and its impact on the marriage certificate As for the Algerian legislator, he adopted the position of those who authorized this condition and allowed, through the provision of the section 19 of Family code, amended by the ordinance No05/02, the wife to exercise her right to stipulate work. And he obliged the husband to fulfill this . condition in accordance to legal texts which require the fulfillment of promises If the husband has failed in this condition, the wife has the right to request repudiation for violation of the condition and to claim damages for .damage
