الحماية القانونية للمتعاقد الضعيف من الإكراه الإقتصادي في ظل أزمةفيروس كورونا (covid-19)

Résumé: إن التكريس الفعلي لمبادئ النظام العام الإقتصادي الحمائي يتجسد من خلال تبني نظريات جديدة أو تطويع قواعد قديمة لحماية المتعاقد الضعيف من جهة، والمحافظة على مكانة العقد باعتباره الوسيلة الأكثر انتشارا للتعامل بين الأفراد من جهة أخرى، ولعل أهم هذه النظريات هي نظرية الإكراه الإقتصادي والتي استحدثها القضاء الفرنسي كآلية لحماية المتعاقد الضعيف من أي ممارسات تعسفية، وذلك سعيا منه إلى إعادة القانون المدني لمكانته الأولى كشريعة عامة بعد تراجعها في ظل تشريعات الإستهلاك. وقد تسبب فيروس كورونا (covid – 19) في انتشار هذه الممارسات التعسفية وأثر بشكل سلبي على العلاقات العقدية عموما وعلى إرادة المتعاقدين بشكل خاص، حيث أدى التفاوت الكبير في المراكز الإقتصادية بين المتعاقدين إلى اختلال التوازن العقدي، ما استوجب توفير الحماية القانونية للأطراف من أي ضغوطات قد تمس بصحة العقد سواء بتدخل من المشرع أو القضاء، من خلال التصدي للإحتكار والإستغلال التعسفي لوضعيات الهيمنة الإقتصادية. الكلمات المفتاحية: الإكراه الاقتصادي، العقد، الحماية القانونية، فيروس كورونا، التوازن العقدي. Abstract: The actual devotion of the principles of the general economic protectionist system is embodied by adopting new theories or adapting old rules to protect the weak contractor on the one hand, and maintaining the position of the contract as the most prevalent method of interaction between individuals on the other hand, and perhaps the most important of these theories is the economic coercion theory that was introduced by the judiciary The French as a mechanism to protect the weak contractor from any abusive practices. The Corona virus (covid - 19) caused the spread of these arbitrary practices and negatively affected the contractual relations in general and Especially the contractorsr. It may affect the validity of the contract, whether by the intervention of the legislator or the judiciary, by addressing the monopoly and the arbitrary exploitation of the modes of economic domination. key words: Economic coercion, contract, legal protection, corona virus, nodal balance.
