الحماية القانونية لاستقلالية الذمة المالية للزوجة في التشريع الجزائري

Résumé: لطالما كانت الأسرة و لا زالت محل اهتمام التشريعات الوضعية باعتبارها اللبنة الأولى للمجتمع، و المشرع الجزائري بدوره حرص أشد الحرص على تنظيم مختلف الأحكام المتعلقة بها مستمدا ذلك من الشريعة الاسلامية الغرّاء، فقام بتدعيم روابط الأسرة و بيان حقوق أفرادها بعضهم من بعض، كما قرر الجزاء الذي يكفل صيانة هذه الحقوق، غير أن توافر هذه الأحكام القانونية لا يحول دون تعرض الأسرة إلى عوامل عدة تؤدي إلى زعزعة استقرارها، و المساس بكيانها، و لعل أبرز هذه العوامل تلك التي تمس بالجانب المالي، و التي أضحت السبب الأول في إثارة المشاكل و الخلافات بين الزوجين، خاصة في ظل المستجدات التي فرضها التطور الاجتماعي و الاقتصادي و الثقافي و الذي طال الأسرة الجزائرية أبرزها مساهمة الزوجة لاسيما العاملة في تكوين ثروة الأسرة ما فرض على المشرع استحداث نظام قانوني يضمن حقوقها المالية و حريتها الكاملة في التصرف فيها باعتبارها الطرف الأضعف في العلاقة. كلمات مفتاحية: استقلالية الذمة المالية، العقد المالي ، الاستيلاء على أموال الزوجة،الاشتراك في الأموال، النظام المالي. abstract The family has always been and continues to be the focus of positive legislation as the first building block of society, and the Algerian legislator, in turn, was very keen to regulate the various provisions related to it, deriving this from the glue Islamic Sharia, so he strengthened the ties of the family and explained the rights of its members to each other, and decided the penalty which guarantees the maintenance of these rights, but the availability of these legal provisions does not prevent the family from being exposed to several factors that destabilize it and affect its entity. Perhaps the most prominent of these factors are those that affect the financial aspect, Which became the first reason for raising social, economic and cultural development that affected the Algerian family, most notably the contribution of the wife, especially the worker, to the formation of the family’s wealth, Its complete freedom to dispose of it as the weakest party in the relationship.
