قاعدة: الإثبات أولى من النفي عند الإمام ابن العربي من خلال كتابه: المسالك في شرح موطأ مالك
Résumé: ملخص: هذا المقال يدرس قاعدة شهيرة أوردها الإمام ابن العربي في كتابه: المسالك في شرح موطأ مالك. وهي قاعدة:"الإثبات أولى من النفي". وقد جاء المقال في مبحثين. تعرضت في المبحث الأول لتعريف للإمام ابن العربي، ولكتابه المسالك، وتعريف بأصل الاستصحاب وبيان أنواعه. أما في الثاني فقدت قمت بشرح القاعدة، وذكرت بعضا من أدلتها. ثم عرضت نماذج لفروعها من كتاب المسالك، وأنهيت المقال بجملة من الملاحظات والمحددات والضوابط للقاعدة. Abstract : This article examines a famous rule that Imam Ibn Al-Arabi included in his book: Al-Masalak fi SharhMuwatta Malik. It is a rule: "Evidence is first than denial." The article came in two sections. In the first topic, I presented a definition of Imam Ibn al-Arabi, his book Al-Masalak, and a definition of the origin of Al-Issahab and an explanation of its types. In the second, I lost an explanation of the rule, and mentioned some of its evidence. Then she presented examples of its branches from the book of paths, and ended the article with a set of observations, determinants and rules for this rule
