قـواعـد المقاصد عند الإمام ابن العربي - من خلال كتابه : المسالك في شرح موطأ مالك

Résumé: يدرس البحث قواعد المقاصد من خلال كتاب: "المسالك في شرح موطأ مالك". ويرتكز على إشكالية رئيسية: إلى أي مدى ضَمَّن الإمام ابن العربي قواعد المقاصد في كتابه المسالك؟ وماهي إسهامات الإمام ابن العربي في قواعد المقاصد من خلال كتابه المسالك؟ ويقع في قسمين. ذكرت في القسم الأول التعريف: بابن العربي, وكتابه المسالك, والمقاصد وقواعدها. ففي الفصـــل الأول من هذا القسم: درست عصر الإمام ابن العربي وحياته بذكر نسبه, ونشأته العلمية, وشيوخه وتلامذته ومكانته العلمية. وفي الفصل الثاني: التعريــف بكتاب: "المسالك في شرح موطأ مالك", عرفت فيه بكتابه المسالك, فبيَّنْت نسبتة لمؤلفه, وأوردت منهجه وبعض المآخذ عليه, وأهم مصادره ومميزاته. وفي الفصل الثالث: تطرقت لنشأة علم المقاصد وتطوره. بدأت فيه بتعريف المقاصد, وذكر الألفاظ ذات الصلة, ثم نشــأة علم المقاصــد وتطـوره. وفي الفصل الرابع: الفكر المقاصدي عند الإمام ابن العربي. ذكرت فيه العوامل المؤثرة في التكوين المقاصدي عند ابن العربي.ثم مظاهر المقاصد عنده من مراعاته المعاني وإعماله القياس, والتعليل. والتنبيه على المقاصد العامة والخاصة. أما في الفصل الخامس: فقد تناولت قواعد المقاصد, فنبهت إلى تمييزها عن غيرها من القواعد كالأصولية والفقهية والضوابط الفقهية. ثم بينت حقيقة القاعدة المقاصدية وتقسيماتها. واستقرأت في مبحث أخير التقعيد وأصوله ومنهجه عند ابن العربي. أما في القسم الثاني من الدراسة فقد خصصته لقواعد المقاصد من كتاب المسالك. حيث أوردت في الفصـــل الأول: قواعد تتعلق بمقاصد المكلفين, وبالحرية والأنساب. في ثلاثة مباحث, تطرقت في المبحث الأول لقاعدة "الأعمال بالنيات", وتطبيقاتها الكثير في الكتاب. وفي الثاني لجملة من القواعد تتعلق بمقاصد المكلفين. وفي المبحث الثالث من هذا الفصل أوردت قواعد في اعتبار الجنس بالمقاصد, وقاعدة: أنَّ الأَصلَ في الإنسان الحرية, وقاعدة "الشَّرْعُ موضوعٌ على تخليصِ الأنساب". أمَّا في الفصل الثاني فقد تناولت قاعدة المصلحة, فعرفت المصلحة وبَيَّنْتُ علاقتها بالمقاصد. وذكرت أمثلة لتخصيص العموم بالمصلحة عند ابن العربي, وحددت عددا من ضوابطها, وأمثلة لأدلتها, وتطبيقاتها. ثم أوردت قواعد تتعلق بالمفسدة, كقاعدة "النَّهيُ يقتضي فسادَ المَنْهِيِّ عنه", وقاعدة "كلّ ما ينبني على غير قاعدةٍ فهو واهٍ". وفي المبحث الأخير من هذا الفصل تنازلت التعليل وصلته بالمقاصد, وذكرت جملة من أدلته, وأمثلة لتطبيقاته. وفي الفصل الثالث أدرجت قواعد رفع الحرج, وقاعدة "إسقاط التكليف فيما لا يُطَاق, وقاعدة مَا شُرع لِعُذْرٍ بَطَلَ بِزَوَالِهِ. وفي المبحث الثاني من هذا الفصل أتيت على ذكر قاعدة الْمَشَقَّةُ تَجْلِبُ التَّيْسِيرَ, بشرح القاعدة, وبيان أدلتها, وذكرت أسباب التخفيف, وضابط الْمَشَقَّةِ التي تَجْلِبُ التَّيْسِير. وفي مبحث أخير ذكرت قواعد تتعلق بالضرر, كقاعدة "لَا ضَرَر وَلَا ضرار. وقاعدة "الضَّرَرَ لا يُستحَقُّ بالقِدَمِ. وقاعدة "يُرفَعُ أعظمُ الضَّرَر بأهونَ منه.و قاعدة "للمرء أنّ يتحمّل الضّرر في نفسه إنَّ كان يسيرًا، وليس له أنّ يلحقه بغيره يسيرًا كان أو كثيرًا". وفي الفصل الرابع أدرجت قواعد تتعلق بالرخص منها: قاعدة "الرُّخَصُ أبدًا مبنية على التَّخفيفِ". وقاعدة "ما لا يمكن الاحتراز منه فهو معفو عنه". وقاعدة "يسيرَ الغَرَرِ مَعْفُوٌ عنه". وفي المبحث الثاني: ذكرت قاعدة "الرُّخصةَ موقوفة على الحاجة، تجوزُ بجوازِها وتمنعُ بعدَمِها". وقاعدة "اعتبار الحاجة في تجويز الممنوع, كاعتبار الضرورة في تحليل المحرم". وقاعدة "ما أُبِيحَ للحاجة يُقَدَّر بقدرها" وفي المبحث الثالث درست قواعد الرخص الواردة على الضرورة. كقاعدة "الضّرورةَ قَدْ رَفَعتِ التَّحريمَ وأثبتتِ الإباحة". وقاعدة "كلَّ ما دَعَت الضّرورةُ إليه من المحظورِ فإنّه ساقطُ الاعتبارِ, على حَسَبِ الحاجةِ وبقَدْرِ الضّرورة". وقاعدة: "المعصية لا رُخصَة فيها ولا اعتبارَ بها. وفي الفصل الخامس أدرجت قواعد المقاصد المتعلقة بمآلات الأفعال. ذكرت في مبحث أول تعريف المآل وبيان شروطه وصلته بالمقاصد.و أدلة اعتباره, ونماذج تطبيقية لقاعدة اعتبار المآل. وفي المبحث الثاني: أدرجت قاعدة "سد الذرائع", سد الذرائع وصلته بالمقاصد والمآل وحجيته. والأثر الفقهي لاعتبار مآلات الأفعال في سد الذرائع. وقاعدة "كل ما حقق المقصود فهو مشروع". أما في المبحث الثالث: فقد أوردت قواعد متعلقة بالاحتياط. كمراعاة الخلاف". وقاعدة " تعيُّنُ الاحتياط". في آخر البحث أنهيته بخاتمة عرضت فيها أهم نتائج البحث والتوصيات. ليأتي بعدها مجوعة من الفهارس الفنية تفيد في الرجوع للموضوع, والاستفادة منه. The present study examines the jurisprudential rules of Al-Maqasid (purposes) through the book of "Al Massalek in Explaining Muata Malek". It investigates to what extent did Al Imam Ibn Alarabi incorporate these Maqasid (purposes) in his book, and what are his contributions. There are two parts in this study: in the first one I introduced Ibn Alarabi, his book, Al-Maqasid and their rules. In the first chapter of Part I, I studied the era of Imam Ibn Alarabi and his life by mentioning his lineage, education, teachers, students and scientific position. The second chapter discussed the book of "Al Massalek in Explaining Muata Malek" through its author, methodology, characteristics and main resources. The third chapter was devoted to the beginning of the science of Al-Maqasid (purposes), definition, development and terminology. The fourth chapter highlighted Ibn Alarabi’s thought of Al-Maqasid (purposes), the factors affecting the formation of this thought, and its features such as considering meanings, implementing measurement, explaining and attending to general and specific purposes. The fifth chapter displayed the rules of Al-Maqasid and its distinction from other jurisprudential rules. I explained the notion of Al-Maqasid’s rules and its divisions, and defined Taqiid (rule setting) and its origins and methodology at Ibn Alarabi. The second part of the study, devoted to Al-Maqasid’s rules in “Al Massalek”, is also divided into five chapters. The first chapter discussed some rules related the adult Maqasid, freedom and lineage. In the three sections of this chapter I respectively dealt with the rule of “implementing intention” and its various implications in the book, a number of rules related to the adults, and rules of gender Maqasid consideration. In the second chapter, I focused on the rule of “interest” and showed its relation to Al-Maqasid. I mentioned examples of specifying generalities by interest, and determined a number of settings and examples of evidence and applications. I also introduced some rules connected to “corruption” such as the rule of “prohibition implies the corruption of the prohibited” and the rule of “all that is built on no basic rule is weak”. The last section dealt with justification and its relationship with Al- Maqasid, where some proofs, examples, and implications where sited. I introduced in the third chapter the rules of “lifting embarrassment”, the rule of “dropping commissioning for the unbearable”. In the second section, I explained the rule of “difficulty brings alleviation”, showed its proofs and the reasons of alleviation. In another section, I highlighted many other rules like the rule of “no harming, no reciprocal harming” and “man has to tolerate harm if it is light”. In the first section of the fourth chapter, I listed down some rules related permission such as “permissions are always built on alleviation” and the rule of “what cannot be prevented, is exempted”. In the second section, I mentioned the rule of “permission is dependent on interest” and “considering interest in allowing what is prohibited”. In the third section I surveyed the rules of permission which depend on interest. The fifth chapter, I incorporated the rules related to the results (endings) of actions. In the first section of it, I defined the “ending”, identified its conditions, proofs, implications and its relationship with Al- Maqasid. In another section, I introduced the rule of “preventing excuses” and the rule of “all that realizes what is intended, is legal”. The third section investigated rules related to reservation. I concluded the study with a number of major findings and recommendations, followed by extended technical indexes.
