مكافحة الفساد في الصفقات العمومية Anti-corruption In Public Deals

Résumé: تعتبر الصفقات العمومية من أهم المجالات الحيوية الفاعلة في تنفيذ مشاريع الدولة وبالتالي المساهمة في التنمية وتطوير الإقتصاد و إنجاحه ، مما يجعل الإدارة تلجأ إليها كأهم عقود من أجل تنفيذ مشاريعها الملبية للمصلحة العامة ، و التي تصرف عليها أموال طائلة من الخزينة العمومية مما يجعلها مجالا خصبا للفساد بكل أشكاله. و نظرا لأهمية الصفقات العمومية فقد تطرقنا في هذه الورقة البحثية لعملية الإهتمام بحمايتها من الفساد إنطلاقا من كل المرسوم الرئاسي رقم 15-247 الذي حدد مجموعة من المبادئ والآليات و الإجراءات المقيدة للإدارة في إبرامها للصفقات وتنفيذها التي تحثها على محاربة الفساد ، وكذا قانون الوقاية من الفساد ومحاربته رقم 06/01 الذي أكد بدوره على المبادئ الحاكمة لنزاهة وشفافية إبرام الصفقات العمومية، محددا الجرائم التي تطالها مشددا على عقوباتها وموسعا في مفهوم الموظف العمومي كوقاية من الفساد. Abstract: Public deals are considered one of the most vital and active areas in the implementation of state projects and thus contribute to the development and development of the economy and its success, which makes the administration resort to them as the most important contracts in order to implement its projects that meet the public interest, and on which large sums of money are spent from the public treasury, making it a fertile field for corruption In all its forms. Given the importance of public deals, we have discussed in this research paper the process of taking care of their protection from corruption, based on Presidential Decree No. 15-247, which defined a set of principles, mechanisms and procedures restricting the administration in concluding and implementing deals that urge it to fight corruption, As well as the Prevention and Combating Corruption Law No. 01/06, which in turn emphasized the principles governing the integrity and transparency of the conclusion of public deals, defining the crimes that affect them, stressing their penalties and expanding the concept of the public servant as a prevention from corruption.
