Résumé: لقد اهتم المؤسس الدستوري بموضوع الحقوق والحريات العامة و أولاها عناية خاصة لاسيما الحق في ممارسة حرية الجمعيات باعتبارها أضحت شريكا فعالا للدولة، ويظهر هذا الاهتمام من خلال التكريس الدستوري لها عبر مختلف الدساتير وصولا إلى التعديل الدستوري الأخير لسنة 2020، فقد لعبت هذه الحرية دورا محوريا في توسيع مشاركة الفرد في الحياة العامة والمساهمة في المسار التنموي لاسيما خلال الظروف العادية، غير أنّه قد تعترض الدولة ظروف غير عادية تدفع إلى اتخاذ إجراءات بغية الحفاظ على النظام العام، والتي من شأنها أن تثير اشكالا في ممارسة الحرية وتحد من ممارستها مما يفيد أن ممارسة العمل الجمعوي ليس مطلقا بل قد تحد من فعاليته الظروف الاستثنائية.
