فعالية الحماية القانونية للبيئة من خطر المنشآت المصنفة في التشريع الجزائري

Résumé: يتناول موضوع الدراسة فعالية الحماية القانونية للبيئة من خطر المنشآت المصنفة حيث ركز هذا المقال على حدود الحماية التي كفلها المشرع الجزائري للبيئة من خطر هذه المنشآت سواءا كانت إجراءات وقائية قبلية (دراسة الخطر، دراسة وموجز التأثير، الرخصة) أو بعدية ولاحقة لاستغلالها والمتمثلة في العقوبات الجنائية والإدارية المنصوص عليهما في كل من القانون03/10 والمرسوم التنفيذي 06/198 بالوقوف عند هذه النصوص لمعرفة مدى فعالية هذه الترسانة القانونية على أرض الواقع في وضع حد لخطر هذه المنشآت وتحقيق حماية فعالة للبيئة. This study focuses on the effectiveness of legal protection of the environment against the risk of classified establishments. This article focused on the limits of the protection provided by the Algerian legislator to the environment against the danger of such establishments, whether they are pre-emptive preventive measures (hazard study, impact study and license, or license) or after and after the exploitation of criminal penalties. And the administrative stipulated in both Law 03/10 and Executive Decree 06/198 to stand at these texts to find out the effectiveness of this legal arsenal on the ground to put an end to the risk of these facilities and achieve effective protection of the environment.
