اليات حماية الأراضي الفلاحية الوقفية في التشريع الجزائري

Résumé: تتربع الجزائر على ثروة وقفية ضخمة لاسيما الفلاحية منها، جعلتها تكون من أهم مصادر تمويل المشاريع الإقتصادية والاجتماعية، فضلا عن مساهمتها في تحقيق الأهداف الخيرية، والأمن الغذائي للبلاد. إهتم المشرع الجزائري بهذا المورد الحيوي، بإصدار ترسانة من النصوص القانونية تلت صدور قانون التوجيه العقاري 90/25، تحدد كيفية تنظيمه وحمايته وكذا استثماره عن طريق اليات قانونية ناجعة تسمح بتنميته والمحافظة عليه وتحقق مقاصده، سنحاول في هذه الورقة البحثية تبيان مدى فاعلية الاليات التي كرسها المشرع الجزائري لاستغلال وحماية الأراضي الفلاحية الوقفية؟ Alegria has a huge endowment wealth, especially peasants, which has made it one of the most important sources of financing for economic and social projects, as well as its contribution to the achievement of charitable goals and the country's food security. The Algerian legislature is interested in this vital resource by issuing an arsenal of legal texts following the promulgation of Land Directive 90/25, which sets out how to regulate and protect it and invest it through effective legal mechanisms that allow its development, preservation and achievement of its purposes , In this paper, will we try to demonstrate the effectiveness of the mechanisms devoted by Algerian legislation to the exploitation and protection of the endowment's farmland.
