دور المشرع الجزائري في إعادة التوازن للعقد الالكتروني

Résumé: بالرغم من المزايا العديدة التي تحققها عقود التجارة الإلكترونية لمن يبرمها، فإنها تنطوي في ذات الوقت على مخاطر عديدة بسبب تفاوت المراكز القانونية بين طرفي العقد، الأمر الذي دفع بالمشرع الجزائري إلى إصدار القانون رقم 05/18 المؤرخ في 10 ماي 2018 المتعلق بالتجارة الإلكترونية، والذي حاول من خلاله تحقيق التوازن للعقد الالكتروني بوضع مجموعة من القواعد القانونية تهدف إلى حماية المستهلك باعتباره الطرف الضعيف في العلاقة، سواء في المرحلة السابقة على إبرام العقد، أو بعد إبرامه. Despite the many advantages that e-commerce contracts bring to those who sign them, they involve many risks at the same time due to the disparity of legal positions between the two parties to the contract, which prompted the Algerian legislator to issue Law No. 18/05 of May 10, 2018, related to electronic commerce, which Through it, he tried to achieve a balance for the electronic contract by developing a set of legal rules aimed at protecting the consumer as the weak party in the relationship, whether in the stage prior to the conclusion of the contract, or after its conclusion.
