مشروعية إنتهاك الحق في الخصوصية الجينية في مجال الإثبات الجنائي Legality Of Infringement Of The Right To Genetic Privacy In The Field Of Criminal Evidence

Résumé: ملخص: إن المناداة بالحماية الجنائية للحق في الخصوصية الجينية كانت هي القاعدة، و بما أنه لكل قاعدة استثناء، فإن هذه الحماية ليست مطلقة, بل وجب الموازنة بين حق الفرد في خصوصية جيناته الوراثية و بين حق المجتمع في الأمن و السلم و حقه في العقاب, و كذا الحق في مواكبة التطور العلمي و الاستفادة من اجابياته. على هذا الأساس تم اقرار جواز الاعتماد على الجينات الوراثية في بعض الحالات المحددة قانونا كحالة البحث العلمي حالة الضرورة، و الأهم من ذلك هو الإستعانة بها في مجال الإثبات الجنائي. ذلك بالإضافة إلى وضع مجموعة من الضوابط و القواعد التي يحب الالتزام بها لضمان مساس مشروع بالحق في الخصوصية الجينية. Abstract: The call for criminal protection of the right to genetic privacy was the norm, and since each exception rule, such protection is not absolute, but the balance between the right of the individual to the privacy of his genetic genes and the right of society to security and peace and the right to punishment, The right to keep pace with scientific development and to benefit from its answers. On this basis, it has been established that it is permissible to rely on genetic genes in certain legally defined cases, such as the case of scientific research, the state of necessity and, most importantly, the use of criminal evidence. In addition to developing a set of controls and rules to be adhered to to ensure legitimate prejudice to the right to genetic privacy.
