منح امتياز استغلال خدمات النقل البحري في الجزائر

Résumé: يمكن الوزير المكلف بالبحرية التجارية منح امتياز استغلال خدمات النقل البحري للشخص الطبيعي أو الشخص المعنوي، إذا توفرت الشروط المحددة لا سيما في المادتين 04 و05 من المرسوم التنفيذي 08-57، وفق الإجراءات التي حددها المرسوم التنفيذي المذكور، ليتوج المنح بالتوقيع على اتفاقية منح الامتياز والتوقيع على دفتر الشروط. يترتب على توقيع اتفاقية امتياز استغلال خدمات النقل البحري العديد من الآثار تخص طرفي الاتفاقية، وهما: السلطة المانحة من جهة، وصاحب الامتياز من جهة ثانية، وهي عبارة عن التزامات تقع على عاتق طرفي الاتفاقية. The Minister in charge of the Merchant Marine can grant the concession of exploiting maritime transport services to a natural person or a legal person, if the specified conditions are met, especially in Articles 04 and 05 of Executive Decree 08-57, according to the procedures specified by the aforementioned Executive Decree to culminate in granting the concession by signing the concession agreement and signing the Conditions book. The signing of the concession agreement for the exploitation of maritime transport services entails many effects on both parties to the agreement, namely the granting authority on the one hand and the concessionaire on the other hand, which are obligations that fall on the shoulders of both parties to the agreement. Le ministre chargé de la marine marchande peut accorder la concession d'exploitation des services de transport maritime à une personne physique ou à une personne morale, si les conditions précisées sont remplies, notamment aux articles 04 et 05 du décret exécutif 08-57, conformément au procédures précisées par le décret exécutif susvisé pour aboutir à l'octroi de la subvention par la signature du contrat de concession et la signature du Cahier des Charges. La signature de la convention de concession pour l'exploitation des services de transport maritime entraîne de nombreux effets pour les deux parties à la convention, à savoir l'autorité concédante d'une part et le concessionnaire d'autre part, qui sont des obligations qui incombent aux deux parties à l'accord.
