نطاق عقد امتياز خدمات النقل البحري من خلال المرسوم التنفيذي 57/08

Résumé: اتجه المشرع الجزائري إلى خوصصة قطاع النقل البحري من خلال تعديله للقانون البحري سنة 1998 خاصة المادة 571 منه. حيث أصبح قطاع النقل البحري مفتوحا للخواص ، من خلال عقد امتياز استغلال خدمات النقل البحري الذي حددت شروط منحه في المرسوم التنفيذي 08/57 ، و تتمثل خدمات النقل البحري المنصوص عليها في هذا المرسوم في نقل البضائع و نقل الأشخاص فيما يعرف بالملاحة التجارية ، التي حدد نطاق ممارستها في الملاحة قرب السواحل والملاحة المحدودة و الملاحة غير المحدودة ،حيث يمنح هذا الامتياز وفقا لعدة شروط تتعلق بصاحب الامتياز و كذا شروط متعلقة بالسفينة. The Algerian legislature has sought to privatize the maritime transport sector by amending the Maritime law in 1998,particularly the article 571 thereof, whereby the maritime transport sector became open to private individuals through a concession contract for the exploitation of maritime transport services, which determined his conditions for granting by executive decree n 08/57.The maritime transport services provided for in this decree are transport of persons and transport of goods in what is known as commercial navigation, which determined its scope in 3 places : navigation near the coasts , limited navigation , and unlimited navigation. This concession is granted under several conditions which relating to the concessionaire and conditions relating to the ship.
