دور المعارضة البرلمانية في مراقبة عمل الحكومة - دراسة على ضوء التعديل الدستوري الجزائري لسنة 2016 -

Résumé: تهدف هذه الدراسة إلى بيان دور المعارضة البرلمانية في مراقبة عمل الحكومة، والمنصوص عليه في الفقرة الرابعة من المادة 114 من التعديل الدستوري لسنة 2016. وهذا الدور يظهر من خلال حق المعارضة البرلمانية ممارسة مجموعة من الآليات سواء المرتبة للمسؤولية السياسية للحكومة أو غير المرتبة لها. لكن ورغم هذا التنوع في استعمال هذه الآليات إلا أنها مفتقدة للقيمة والفاعلية، وأساس ذلك الشروط التي فرضها المؤسس الدستوري الأمر الذي يجعل تطبيقها صعب التحقيق خاصة في ظل وجود أغلبية برلمانية مساندة للحكومة. وأخير نستعرض بعض الاستنتاجات حول الموضوع، وبعض الاقتراحات التي يمكن أن تسهم في فاعلية الدور الرقابي للمعارضة البرلمانية مما يؤدي في نهاية الأمر إلى بناء دولة قوية. كلمات مفتاحية: التعديل الدستوري. الحكومة.، البرلمان.، المسؤولية السياسية.، المعارضة البرلمانية. Abstract: The present study aims at illustrating the role of parliamentary opposition in controlling the government work, as stipulated in the clause n°4 of the article 114 from the constitutional amendment. This role is manifested through the right of the parliamentary opposition an exercising a set of mechanisms whether they are classifying the government political responsibility or not classifying it. Despite of the various manners in using these mechanisms, they are lacking of value and effectiveness, and this is owing to the conditions which, imposed by the constitutional institutions, makes its application so hard especially when the parliamentary majority is supporting government. Finally, we review some conclusions on the subject and some suggestions that can contribute to the effectiveness of the oversight role of the parliamentary opposition, which ultimately leads to the building of a strong state.
