Résumé: ملخص: تتميز الجريمة الاقتصادية بأحكام خاصة في ركنها المادي مما يعني بالنتيجة الخروج عن القواعد العامة لقانون العقوبات في هذا المجال. بحيث نلاحظ خصوصية في عناصر الركن المادي من حيث السلوك المؤدي للجريمة وحتى نتيجتها، مما أسفر عن تحويل القانون الجنائي من الدور الحمائي إلى الدور التوجيهي. وبالتالي غموض الركن المادي للجريمة الاقتصادية، والذي يعد من إحدى السمات البارزة للقواعد الجزائية في المادة الاقتصادية. Abstract: Economic crime is characterized by special provisions in its material aspect, which means, as a result, a departure from the general rules of the Penal Code in this field. So that we note the specificity in the elements of the material pillar in terms of behavior leading to the crime and even its result, which resulted in the transformation of the criminal law from a protective role to a guiding role. Thus, the ambiguity of the material element of the economic crime, which is one of the prominent features of the penal rules in the economic article.
