ضمانات الحرية الدينية للأقليات من خلال العهدة العمرية والدستور الجزائري - قراءة تحليلية –

Résumé: تعتبر الحرية الدينية من أهم الحريات التي ترافع عنها المنظمات والهيئات الحقوقية سواء على المستوى الداخلي أو الخارجي، خصوصا إذا تعلق الأمر بالأقليات التي تعيش في المجتمعات المسلمة، وقد عمد المؤسس الدستوري في الجزائر من أول دستور بعد الاستقلال إلى دستور 2020 على النص على ضمانات لحماية الحرية الدينية لغير المسلمين المقيمين بالجزائر في عديد من المواد إلتزاما منه بالمواثيق الدولية واستجابة لتطلعات الرأي العام، وقبل هذا فإن الإسلام سبق مختلف الأنظمة الوضعية في إقراره للحرية الدينية للفرد فلا يكره أحد على ترك عقيدته حتى وإن كان مقيما في دار الإسلام، وكأنموذج على ذلك العهدة العمرية التي أقرها الخليفة عمر لأهل إيلياء التي تمثل إحدى الدرر التي تجسد روح الإسلام من خلال ما تضمنته من ضمانات صريحة لأهل إيلياء، وهذا ما تم تناوله في هذه الورقة البحثية. Religious freedom is one of the most important freedoms advocated by human rights organizations and bodies, whether internally or externally, especially when it comes to minorities living in Muslim societies, the constitutional founder in Algeria has baptized from the first constitution after independence to the 2020 constitution to provide guarantees to protect the religious freedom of non-muslims residing in Algeria in several articles committed to international conventions and in response to the aspirations of public opinion, Before that, Islam preceded the various man made systems in its recognition of the religious freedom of the individual, so no one is forced to leave his faith, even if he is residing in the house of Islam, as an example of this, the Covenant of Omar which was approved by the Caliph Omar to the people of Aelia, which represents one of the pearls that embody the spirit of Islam through the explicit guarantees it contains for the people for Aelia, and this is what has been addressed in this research paper.
