مظاهر ممارسة الشعائر الدينية لغير المسلمين في التشريع الجزائري (قراءة تحليلية تقييمية للأمر رقم: 06-03 يحدد شروط وقواعد ممارسة الشعائر الدينية لغير المسلمين)

Résumé: الملخص: تخضع ممارســة الشــعائر الدينيـــة لغيــر المســلمين فــي الجزائر لجملة من النصــوص القانونية، حيث كفل المشرع الجزائري ضمانات ممارسة الشعائر الدينية لغير المسلمين، إلا أن هذه الضمانات منوطة باحترام القوانين، وكذا خصوصية المجتمع الجزائري وأعرافه، وهذا ما دفع بالمشرع الجزائري لفرض جملة من القيود حال ممارسة هذه الشعائر. هذا؛ وتهدف هذه الدراسة للوقوف على الأمر رقم: 06-03 المحدد لشروط وكيفيات ممارســة الشــعائر الدينيــة لغيــر المســلمين، من خلال البنايـات المخصصـة لممارسـة الشـعائر الدينيـة شريطة حصولها على تراخيص مسبقة مــن طـرف الجهـات المختصــة بغية أداء عباداتهم وتظاهراتهم الدينية. Summary: The practice of religious rituals for non-Muslims in Algeria is subject to a set of legal texts, as the Algerian legislator has guaranteed guarantees for the practice of religious rites for non-Muslims, but these guarantees are contingent on the respect of laws, as well as the privacy of Algerian society and its customs, and this is what prompted the Algerian legislator to impose a set of restrictions when practicing these Rituals. This; This study aims to find out Order No. 06-03 specifying the conditions and modalities for practicing religious rites for non-Muslims, through buildings designated for practicing religious rites, provided that they obtain prior licenses from the competent authorities in order to perform their religious rituals and demonstrations.
