خصوصية المسؤولية الجنائية للشخص المعنوي في الجريمة الاقتصادية والبيئية

Résumé: ملخص : تنشأ مؤسسات مصنفة ذات نشاط متعدد ومختلف من خلال التطور الاقتصادي الذي خلق العديد من المجالات التي تساعد المؤسسات على النمو حيث أعطت هذه الأخيرة دور فعال للشخص المعنوي حيث يلعب عنصر أساسي في تسيير هذه المؤسسات من جهة التطور والتقدم لكن كما تعطي هذه الأخيرة دور إيجابي للشخص المعنوي تعطيه أيضا في المقابل دور سلبي من ناحية ارتكابه لبعض الجرائم الاقتصادية والبيئية وغيرها من الجرائم التي تجعل الشخص المعنوي أو ممثليه أو تابعيه يتحملون المسؤولية الجنائية عن أفعالهم وتصرفاتهم المخالفة للقانون وذلك بتمييز بعض الاحكام الخاصة التي تمشي عليها القاعدة القانونية خلال تطبيق قوانين الحماية الجنائية من الجرائم الاقتصادية والبيئية . الكلمات المفتاحية : المسؤولية الجنائية الاقتصادية – مؤسسات مصنفة – الجريمة الاقتصادية – الجريمة البيئية - المسؤولية الجنائية البيئية. Abstarct : Classified institutions with multiple and different activities arise through economic development, which has created many courtesies that help institutions to grow, as the latter has given an effective role to the legal person, as it plays the main role in the running of these institutions in terms of progress and development, but as the latter gives a positive role to the legal person, it also gives him in return a negative role in terms of some committing economic, environmental and other crimes that make the legal person, its representatives or subordinates bear Criminal responsibility for their actions and actions contrary to the law, by conducting some special provisions that the legal rule follows during the application of criminal protection laws from economic and environmental crimes.
