خصوصية المسؤولية الجنائية في الجريمة الاقتصادية

Résumé: يهدف بحثنا هذا إلى إبراز خصوصية الجريمة في المجال الاقتصادي، التي لها أحكام خاصة ،تخرج عن القواعد العامة في مجال التجريم و العقاب،مثل التفويض التشريعي للسلطة التنفيذية،إضافة إلى ضعف الركن المعنوي الذي يفترض وجود القصد و يكتفي بحدوث الخطأ، إضافة الى كون الجرائم الاقتصادية جرائم مادية. والذي يهمنا في بحثنا هذا هو نطاق المسؤولية الجنائية في الجرائم الاقتصادية، و القواعد الاستثنائية التي وضعها المشرع الجزائري عند تنظيم القطاع الاقتصادي ،و توضيح الطبيعة الخاصة التي تميزها عن غيرها من الجرائم،كإسناد المسؤولية الجزائية عن فعل الغير و إسنادها للشخص المعنوي ذو الطبيعة الاقتصادية Our research aims to highlight the privacy of the crime in the economic field, which has special provisions, which deviate from general rules in the field of criminalization and punishment, such as the legislative delegation of the executive authority, the weak moral pillar that assumes the existence of intent and is satisfied with the occurrence of error, in addition to the fact that crimes Economic material crimes. What interests us in our research is the scope of criminal responsibility in economic crimes, the exceptional rules that the Algerian legislator put in place when regulating the economic sector, and clarifying the special nature that distinguishes it from other crimes, such as assigning criminal responsibility for the act of others and assigning it to the legal person of an economic nature.
