مبدأ حسن النية في المرحلة السابقة على ابرام عقود التجارة الدولية

Résumé: ملخص: تستهدف هذه الدراسة بيان الدور الذي يلعبه مبدأ حسن النية باعتباره قيدا واردا على حرية الأطراف في مرحلة تكوين عقود التجارة الدولية، لإضفاء الثقة المشروعة على عملية تحضير شروط العقد النهائي، ليأتي هذا الأخير متوازنا في الحقوق والالتزامات التي يرتبها، مراعيا لمصالح الطرفين حتى لا تثار المنازعات بشأنه في مرحلة تنفيذه، وليستمر التعاون بين الطرفين مستقبلا. Abstract This study aims to clarify the role that the principle of good faith plays as a constraint on the freedom of the parties at the stage of forming international trade contracts in giving legitimate confidence to the process of preparing the terms of the final contract, so that the latter is balanced in the rights and obligations it arranges, taking into account the interests of the parties so that no disputes arise regarding it in the implementation phase and to continue cooperation between the two parties in the future.
