الإجراءات الإدارية والقضائية للمنازعات الجبائية في التشريع الجزائري

Résumé: تعتبر الإجراءات الأكثر أهمية في المنازعات بصفة عامة والإدارية بصفة خاصة كون القانون الإداري مرن ويخضع للتعديل المستمر من طرف المشرع تماشيا والتطورات الاقتصادية والمالية ، والمنازعة الجبائية بصفة اخص تخضع لإجراءات و شروط محددة قانونا حسب المرحلة التي يكون فيها النزاع إما على مستوى الإدارة فيخضع لأحكام قانون الإجراءات الجبائية واما على مستوى القضاء فيخضع لإجراءات قضائية وفقا لأحكام قانون الإجراءات المدنية والإدارية ، وان احترام هذه الإجراءات الإدارية كفيل بفض النزاع الجبائي وبالتالي يمكن ان تصبح طريقا بديلا عن التسوية القضائية . The procedures are considered the most important in disputes in general and administrative ones in particular, as the administrative law is flexible and subject to continuous amendment by the legislator in line with economic and financial developments. The tax dispute in particular is subject to legally defined procedures and conditions depending on the stage in which the dispute is, either at the administrative level and subject to the provisions of the procedural law. At the level of the judiciary, it is subject to judicial procedures in accordance with the provisions of the Civil and Administrative Procedures Law. Respecting these administrative procedures is sufficient to resolve the tax dispute, and therefore it can become an alternative path to judicial settlement.
