مسؤولية الحماية: إعادة إحياءالتدخل الإنساني

Résumé: إن تحوّل الأمم المتحدة من التدخل الإنساني إلى مبدأ مسؤولية الحماية، كان نتيجة لإشكالات وصعوبات قانونية و سياسية حالت دون إمكانية الاستمرار في تطبيق التدخل الإنساني، بالإضافة إلى أن أغلب تطبيقات التدخل الإنساني السابقة تراوحت بين الفشل أو الانحراف عن تحقيق الأهداف المحددة، حيث أثمرت جهود المجتمع الدولي بإقرار مؤتمر الألفية عام 2005 عن ميلاد مبدأ "مسؤولية الحماية" كبديل للتدخل الإنساني وما ترتب عليه من تعديل على مفاهيم مبدأي السيادة و عدم التدخل في الشؤون الداخلية، وبموجب مبدأ مسؤولية الحماية فإن واجب حماية حقوق سكان الدولة يقع بالدرجة الأولى على عاتق الدولة و يقابله التزام إيجابي من قبل المجتمع الدولي بدعم جهود الدولة في هذا المجال، و لكن إذا فشلت هذه الجهود أو ثبت تقصير أو عدم رغبة الدولة بالوفاء بالالتزامات التي تقع على عاتقها فإن المجتمع الدولي مطالب بالتدخل من أجل حماية حقوق الإنسان. Abstract The transformation of the United Nations from humanitarian intervention to the principle of the responsibility to protect, was the result of legal and political problems and difficulties that prevented the possibility of continuing to apply humanitarian intervention, Most of the previous instances of humanitarian intervention expired in failure or deviationto achieve goals. As the efforts of the international community to endorse the Millennium Conference in 2005 resulted in the birth of the principle of "the responsibility to protect" as an alternative to humanitarian intervention and the consequent amendment to the concepts of the principles of sovereignty and non-interference in internal affairs, and according to the principle of the responsibility to protect, the duty to protect the rights of the residents of the state falls primarily on It is the responsibility of the state and is matched by a positive commitment by the international community to support the efforts of the state in this field, but if these efforts fail, or it is proven that the state fails or does not want to fulfill the obligations that fall upon it, the international community is required to intervene in order to protect human rights.
