Résumé: ملخص: تتناول هذه الدراسة تسليط الضوء على شروط وكيفيات إبرام عقود استثمار الأوقاف العامة المبنية والقابلة للبناء الموجهة للاستثمار في ظل المرسوم التنفيذي رقم 18-213، حيث قمنا من خلالها بتحليل مضمون هذا المرسوم وذلك باستقراء مواده و تحليلها، في محاولة منا ، للإجابة على إشكالية تتمحور حول الشروط الواجب توفرها في المستثمر للحصول على عقد استثمار الأوقاف العامة المبنية والقابلة للبناء الموجهة للاستثمار و التي تضمنها هذا المرسوم و كذا الكيفيات التي يتم عن طريقها منح هذه العقود ، حيث انتهجنا في دراستنا هاته كلا من المنهج التحليلي وكذا الوصفي، هذا وقد خرجنا في نهاية هذه الدراسة بمجموعة من النتائج والتوصيات. Abstract: This study deals withhighlighting the conditions and modalities of concluding the investmentcontracts for the endowments of the public, which are intended for investment underexecut ivedecree no. 18-213, throughwhichw eanalyzed the contents of thisdecree by extrapolatingits articles and analyzingthem in an attempt to answer the problem It focuses on the conditions stipulated in thisdecree to obtain investment contracts for the endowments of the public built and capable of building for investment and the qualifiers through whichthese contractsare awarded.
