شروط و كيفيات استغلال العقارات الوقفية الموجهة للاستثمار

Résumé: يهدف المقال إلى دراسة شروط وكيفيات استغلال العقارات الوقفية المبنية أو الموجهة للبناء لإنجاز مشاريع استثمارية، الواقعة في قطاعات معمرة أو قابلة للتعمير كما هو محدد في أدوات التعمير التي نص عليها القانون رقم 90-29 المتعلق بالتهيئة والتعمير. حيث تتم عملية استغلال العقارات الوقفية، التي تهدف إلى ضمان تثمين هذه الأملاك وتنميتها، طبقا لما حدده المرسوم التنفيذي رقم 18-213، بموجب عقد إداري بين السلطة المكلفة بالأوقاف والمستثمر، ويكون استغلال هذه العقارات، عن طريق تقديم عروض تفتح باب المنافسة لاختيار أحسن مشروع لفائدة الوقف كقاعدة عامة، أو عن طريق التراضي. This article aims to study the conditions and methods of operation of public wakfs real estate, built or inbuilt, intended for the realization of investment projects. Located in the urbanized or urbanizable sectors, as defined by the planning and urban planning instruments provided by the law n 90-29 relative to the urban planning and development. The operation of the exploitation of the wakfs’s real estate intended for the realization of investment projects, which aims at ensuring, the valuation and development of property wakf, as defined by Executive Decree No. 18-213 is performed under an administrative contract between the wakfs authority and the investor. For the purposes of this decree, wakfs properties intended for the realization of investment projects is operated through submission of bids , as a general rule opening the way to competition for the selection of the best project. for the benefit of wakf, or by way of OTC.
