Résumé: الملخص: يهدف هذا المقال إلى تقييم دور المحكمة الجنائية الدولية في النزاع المسلح في سوريا الذي شكل حالة مأساوية هزت الضمير الإنساني وأدخلت الشك في نفوس أنصار العدالة الجنائية ، انطلاقا من مفهوم المسؤولية الجنائية الدولية باعتبارها الجهاز القضائي الدولي الدائم الذي ينظر في مختلف الانتهاكات الجسيمة لقواعد القانون الدولي الإنساني و القانون الدولي لحقوق الإنسان تبيان العقبات التي واجهتها في ذلك و مدى إمكانية تطبيق الجزاءات الدولية على أطراف الصراع الكلمات المفتاحية: المسؤولية الجنائية الدولية – الجرائم الدولية – المحكمة الجنائية الدولية – النزاع المسلح – العقوبات الدولية The International Criminal Resposibility : The Basis and the Obstacles The International Crimes in Syria Abstact This article aims to evaluate the role of the international criminal court on the armie conflict in syria which constituted a tragic situation that shook the human conscience and confused the supporters of criminal justice, starting by the concept of the international criminal responsibility which concerned as a permanent international judicial organ which controle the different grave violations of the rules of the international hamanitarian law and the international law of human rights ,and showing the investigations that facing her ,and possibility to apply the international sanctions on the parties of conflict key words: the international criminal responsibility - international crimes - the international criminal court - the armed conflict - the international sanctions –
