الشفعة الإدارية كآلية لكسب العقار في القانون المدني والتشريعات الخاصة

Résumé: الملخص: يكتسي موضوع الشفعة الإدارية كآلية لكسب العقار أهمية قانونية وإقتصادية وسياسية، لذلك أبرزت الأحكام التي تنظم هذه الآلية بمقتضى نصوص خاصة بناء على الخصوصية التي تميزها عن الشفعة المدنية في ظل أحكام القانون المدني الجزائري، لفتح مجال لملكية بحسن استغلال العقار وحمايته من المضاربة الغير مشروعة والقسمة والتجزئة، وكانت أبرز التوصيات التي خلص إليها هذا العمل البحثي هي إعادة المشرع النظر في الإجراءات التي تحدد ممارستها بدقة على غرار الشفعة المدنية لإزالة كل لبس قد يعيق هذه الآلية. : Abstract The issue of administrative pre-emption as a mechanism to acquire the real estate is of legal, economic and political importance, Therefore, the provisions regulating this mechanism under special texts based on the privacy that distinguishes it from civil preemption under the provisions of the Algerian Civil Code, To open the field of the property with good exploitation of the real estate and it’s protection from illicit speculation, division and fragmentation, One of the main recommendations of this research work is that the legislator should reconsider procedures that strictly define its practice, such as civil pre-emption, to remove any ambiguity that might hinder this mechanism.
