البيع بالمزاد العلني لحق الامتياز الفلاحي في ظل التشريع الجزائري.

Résumé: استنادا للمادة 12 من القانون 10/03 لصاحب حق الامتياز الفلاح الحق في تشكيل الرهن الرسمي على الحق العيني العقاري الناتج عن حق الامتياز الفلاحي لفائدة هيئات القرض بغرض تمويل مشاريع استثمارية، وعليه يلتزم المستثمر بأداء التزاماته في الآجال المقررة وفق بنود عقد الرهن. وفي حال عدم الوفاء بالدين في الأجل المحدد يكون عرضة لإجراءات الحجز هذا مايترتب عنه عملية بيع حق الامتياز الفلاح عن طريق المزاد العلني مع احترام الشروط والإجراءات التي وردت في قانون الإجراءات المدنية والإدارية بالموازنة مع مراعاة أحكام المادة 12/2 سالفة الذكر. Based on the Article 12 of Law 10/03, the holder of the agricultural concession has the right to form an official mortgage on the in-kind right resulting from the agricultural concession right for the benefit of loan agencies and for the purpose of financing investment projects. In case the debt is not honoured within the specified term, it shall be subject to seizure procedures, which results in the process of selling the agricultural concession right through public auction, while respecting the conditions and procedures stated in the Civil and Administrative Procedures Law in the budget, taking into account the provisions of the aforementioned Article 12/2.
