أحكام الرهن الحيازي للمحل التجاري في التشريع الجزائري
Résumé: تتناول هذه الدراسة موضوع الرهن الحيازي في المحل التجاري، والذي يعد من أهم الوسائل القانونية في موضوع النشاط التجاري، والذي يقوم على الاقتراض مقابل رهن المحل التجاري كأموال منقولة، ولكن القانون خص بالذكر أركان وشروط الرهن الحيازي وعليه، لكي نكون أمام رهن محل تجاري صحيح، يجب أن تتوافر شروط موضوعية وشكلية. حيث يترتب عليه آثار تشمل حقوق والتزامات الدائن المرتهن والمدين الحالي، وينتهي عقد الرهن الحيازي للرخصة التجارية لنفس أسباب انتهاء عقد الرهن الرسمي This study deals with the subject of the possessory mortgage in the commercial store ، which is one of the most important legal means in the matter of commercial activity ، which is based on borrowing against the commercial store mortgage as movable money ، but the law singled out the pillars and conditions for the possessory mortgage and accordingly ، in order for us to be in front of avalid commercial store mortgage ، it must be available objective and formal conditions. As it result in effects that include rights and obligations for the mortgagee and the current debtor, and the possessory mortgage contract for the commercial permises expires for the same reasons as the official mortgage contract expires
