قيد الرهن الحيازي في القانون التجاري الجزائري (كبديل عن الحيازة)

Résumé: ملخص: ان دراستنا لموضوع قيد الرهن الحيازي في القانون التجاري الجزائري بشقيه –رهن المحل التجاري و رهن أدوات ومعدات التجهيز- جاء بعد بروز الخصوصية التي يتمتع بها هذا الرهن و المتمثلة في استبدال الحيازة و التي تعتبر من مميزات الرهن الحيازي و الاستعاضة عنها بعملية القيد الذي هو من مميزات الرهن الرسمي ،ومن خلال هذا البحث سنحاول توضيح مختلف اجراءات هذه العملية المتمثلة في القيد بإبراز مكانه و الجهة المخول لها القيام به ، وكذلك الاثار المترتبة في عقد الرهن الحيازي في القانون التجاري بمناسبة هذا القيد كونه يحل مكان الحيازة . الكلمات المفتاحية: القيد ،الرهن الحيازي التجاري ،المدين الراهن، الدائن المرتهن ABSTRACT: Our study of the subject of the registration of the Possessory pledge in the Algerian commercial law, with its two parts - the commercial store pledge and the instruments and equipment’s pledge - came after the emergence of the specificity with which this pledge was Replacing possession, which is one of the characteristics of the pledge, and replacing it with the registration process, which is one of the characteristics of the Official mortgage. Through this research, we will try to clarify the various procedures of this process represented in registration by highlighting its place and the authority authorized to do it, As well as the effects of the pledge in the commercial law on the occasion of this restriction as it replaces the place of possession. key words: Registration, the commercial Possessory pledge, debtor, creditor.
