عقوبة الإعدام بين الالتزام الدولي ومطالب المجتمع الوطني

Résumé: ملخص: تعتبر عقوبة الإعدام من أخطر العقوبات وأشدها على الإطلاق لأنها تفقد الإنسان أثمن قيمة يحاول الحفاظ عليها وهي حقه في الحياة ، لذلك اعتبرت على رأس العقوبات الردعية قديما وحديثا ،وقد أثارت جدلا فقهيا حادا انعكس على بعض التشريعات الوضعية الحديثة من منطلقات وفلسفات مختلفة ، تكمن في كون هذه العقوبة تنعدم بشأنها إمكانية التأهيل والإصلاح ، وهي عناصر أساسية تتصف بها العقوبات في هذا العصر. وقد تناولت هذه الدراسة عقوبة الإعدام كنظام عقابي في محورين : الأول تطرقت فيه إلى عقوبة الإعدام بين المؤيدين والرافضين لحكمها والثاني عرضت فيه موقف الشريعة الإسلامية والتشريع الجزائري من عقوبة الإعدام. و في الأخير تم وضع مجمل النتائج و الاستنتاجات المتوصل إليها من خلال هذه الدراسة في خاتمة البحث و تم تدعيمها ببعض الاقتراحات. Abstract: The death penalty is considered one of the most serious and most severe punishments because it loses the most precious value that it tries to preserve. It is considered the right to life. Therefore, it is regarded as the foremost deterrent punishment in the past and modern. It has provoked a serious jurisprudential controversy that has been reflected in some modern legislations of different principles and philosophies, This punishment lacks the possibility of rehabilitation and reform, which are essential elements of sanctions in this age. This study dealt with the death penalty as a punitive system in two axes: The first dealt with the death penalty between supporters and opponents of its rule And the second presented the position of Islamic law and Algerian legislation of the death penalty. Finally, the results and conclusions reached through this study were summarized in the conclusion of the research and were supported by some suggestions.
