الحق في الخصوصية أثناء تنفيذ العقوبة عن طريق السوار الالكتروني.

Résumé: حاولنا من خلال هذه الورقة البحثية التعرض لموضوع مدى تمتع المحكوم عليه بالحق في الخصوصية أثناء تنفيذ العقوبة عن طريق السوار الالكتروني، وذلك أن السوار الالكتروني هو أحد الأساليب المبتكرة لتنفيذ العقوبة أو الحبس الاحتياطي خارج أسوار السجن، بحيث يسمح لمن يخضع للمراقبة بالبقاء في محل إقامته مع فرض بعض القيود على تحركاته من خلال جهاز المراقبة الإلكترونية ، فعلى الرغم من أن هذا النظام يساهم في إصلاح الجاني عن طريق إبعاده عن الوسط الجرمي من جهة، كما أنه يشكل ضمانة من ضمانات حقوق الإنسان. و كنتيجة نلاحظ أن هذا الجهاز يمكن أن يضمن احترام كرامة الشخص المعني وسلامته وحياته الخاصة عند تنفيذ الوضع تحت المراقبة الإلكترونية، وذلك من خلال تطبيق بعض شروط الاستفادة منه ، بالإضافة إلى أن هذا الإجراء لا يؤثر على الحق في الخصوصية وذلك لأنه أصلا ذو طابع رضائي كونه لا يمكن تطبيقه و مباشرته إلا بطلب من المعني أو على الأقل موافقته. We tried, through this research paper, to address the issue of the extent to which the convict enjoys the right to privacy during the execution of the punishment through the electronic bracelet, and that the electronic bracelet is one of the innovative methods for executing punishment or preventive detention outside the prison walls, so that those who are subject to surveillance are allowed to stay in his place of residence with Imposing some restrictions on his movements through the electronic monitoring device, although this system contributes to reforming the perpetrator by removing him from the criminal environment on the one hand, and it is also a guarantee of human rights. As a result, we note that this device can guarantee respect for the dignity, safety and private life of the person concerned when implementing the situation under electronic surveillance, by applying some conditions for benefiting from it, in addition to that this procedure does not affect the right to privacy because it is already of a consensual nature. It cannot be implemented and directly executed without a request from the concerned person or at least his approval.
