Résumé: ملخص: يعتبر نظام الوضع تحت المراقبة الإلكترونية باستعمال السوار الإلكتروني تقنية حديثة للحفاظ على مقتضيات الرقابة القضائية وتدعيم قرينة البراءة، فهي من بدائل تنفيذ العقوبات السالبة للحرية قصيرة المدة، استحدثها المشرع الجزائري في القانون رقم 18-01 المتمم للقانون رقم 05-04 المؤرخ في 06 فيفري 2005 والمتضمن قانون تنظيم السجون وإعادة الإدماج الاجتماعي للمحبوسين، جاء في ظل تنفيذ برنامج الإصلاح وعصرنة قطاع العدالة، والذي يحمل في طياته عدة مزايا يجسد بها أغراض السياسة العقابية الحديثة التي ترمي إلى ترشيد العقاب والحرص على تأهيل المحكوم عليه. Abstract : The system of placing under electronic surveillance using the electronic bracelet is considered a modern technique to preserve the requirements of judicial control and support the presumption of innocence, as it is one of the alternatives for implementing short-term freedom deprivation penalties. Including the law on organizing prisons and the social reintegration of prisoners, came in light of the implementation of the reform program and modernization of the justice sector, which carries with it several advantages that embody the objectives of the modern penal policy that aims to rationalize punishment and ensure the rehabilitation of the convicted.
