ملامح استقلالية القضاء الجزائري في دستور 2020

Résumé: إن مبدأ استقلالية القضاء من المبادئ المستقرة في الدساتير المعاصرة، إذ من خلاله يتم تجسيد دولة القانون،ولقد نصت العديد من المواثيق الدولية على ضمانات المحاكمة العادلة ولا يتجسد ذلك فعليا إلا باستقلالية القضاء وعدم توجهيه من طرف السلطة التنفيذية أي حين يكون هناك فصل بين السلطات الذي كرسته العديد من الدساتير العالم، والدساتير التي عرفتها الجزائر نصت على ذلك ومنها دستور 2020 في العديد من نصوصه التي تحقق العدالة النزيهة والشفافية لمحاربة الفساد الذي انتشر في كافة الأصعدة ومنها سلك القضاء. ونتحدث عن المكاسب التي حققتها السلطة القضائية في الجزائر بعد الحراك المبارك ومنها تفعيل دور المجلس الأعلى للقضاء رغم ما وجه إليه من انتقادات، ومن جهة أخرى ما ينبغي تحقيقه في المستقبل مقارنة بدساتير المعاصرة لتحسين قطاع العدالة وتأثير ذلك على الإصلاح السياسي والدستوري في البلاد. The principle of the independence of the judiciaryis an establishedprinciple ofcontemporary constitutions. Sinceitis a process in whichthe state of lawisrealized,several international conventions guarantee for the fair trial, but in reality thisonlymaterializeswith the judicialindependence and avoidingits direction by the executiveauthority, thatis, whenthereis a separation of powerswhich has been enshrined in many constitutions in the world,andAlgeria's constitutionsstipulatethis, including the Constitution of 2020 thatprovides forimpartial justice and transparency in the fightagainst corruptionthat has spreadat all levels, including the justice sector. Wediscuss the gains achieved bythe judicialauthorities in Algeriaafter the blessedHirak, such as promoting the role of the Supreme Council of Magistracydespite the criticismitdrew, on the other hand, whatshouldbeachieved in the futureas comparedwithcontemporary constitutions to improve the justice sector and the impact of this on political and constitutionalreform in the country
