Résumé: Through our study of the definition of illegal speculation in Algerian law, we note that the Algerian legislator did not provide for the definition of speculation, unlike other laws that have specific definitions, whether in the stock market, the economy, or others.. It is defined in Islamic law as: “You give a person some of your money in order to trade in it, provided that the profit is between you, or he has a known share of the profit. Commercial transactions are based mainly on the freedom of contract so that each institution has complete freedom to conclude contracts with whomever it wants and according to the terms it deems appropriate and serves its interests.
