قصور التشريع المتعلق بمكافحة المضاربة غير المشروعة في التشريع الجزائري

Résumé: الملخص: جاء قانون 21-15 المتعلق بمكافحة المضاربة غير المشروعة أساسا لتجريم السلوكات التجارية غير النزيهة المستحدثة والتي كانت خارج نطاق التجريم والعقاب في ظل أحكام المواد السابقة التي كانت تأطر جريمة المضاربة غير المشروعة في قانون العقوبات، فوسع المشرع من صور المضاربة غير المشروعة ورصد لها عقوبات جزائية مشددة، كما تضمن أحكاما تنظمية تتعلق بالوقاية من هذه الجريمة من خلال إشراك هيئات المجتمع المدني في محاربة هذه الظاهرة، غير أن أحكام هذا القانون الجديد أبان عن قصور في تطبيق أحكامه لمواجهة هذه الجريمة، بسبب صياغة بعض أحكامه التي تثير لبسا تارة أو بسبب قصور في مضمون النص تارة أخرى. Abstract : Law 15-21 related to combating illegal speculation was the basis for criminalizing novel dishonest commercial conduct, that were not criminalized and were out of punishment under the previous articles that framed the crime of illegal speculation in the penal code. The legislator has expanded the forms of illegal speculation and makes a severe penal punishment, as well as regulatory provisions related to the prevention of this crime through the involvement of civil society organizations in combating this phenomenon. However, the provisions of this new law have shown that their application confront this crime was insufficient, because of the wording of some of its provisions that are sometimes confusing or deficiencies in the content of the text at other times.
