التعاون الدولي في ظل أحكام اتفاقية الأمم المتحدة لمكافحة الفساد وفي القانون الجزائري

Résumé: الملخص نظرا لخطورة جرائم الفساد التي تعدت الحدود الوطنية للدول، حيت أنه في العديد من الحالات يمكن أن يتم ارتكاب الأفعال التي تشكل عناصر الركن المادي لهذه الجرائم في عدة دول، كما يمكن أن يتم تحويل عائدات الجرائم هذه إلى دول أخرى، تبذل جهود حثيثة للمجتمع الدولي من أجل محاربة ظاهرة الفساد، فعلى المستوى الدولي تم اعتماد الاتفاقية الدولية لمكافحة الفساد من طرف الجمعية العامة للأمم المتحدة بتاريخ 31أكتوبر 2003، وعلى المستوى الوطني، تم سن قانون للوقاية من الفساد ومكافحته في الجزائر سنة 2006. ومن بين الأحكام الجديرة بالدراسة والتحليل التي تضمنتها هذه الاتفاقية وكذا هذا القانون تلك التي تم تخصيصها للتعاون الدولي، وبذلك تهدف هذه الدراسة إلى إبراز قيمة هذه الأحكام على مستوى نص الاتفاقية وانعكاساته على النص الداخلي المتمثل في قانون الوقاية من الفساد ومكافحته. Abstract: Given the gravity of corruption crimes that transcend national borders, where in many cases the acts that constitute the material elements of such crimes can be committed in several countries, and the proceeds of such crimes can be transferred to other countries, the international community is making vigorous efforts to combat the phenomenon of corruption. At the international level, the International Convention against Corruption was adopted by the United Nations General Assembly on October 31st, 2003 whereas at the national level, a law to prevent and combat corruption was enacted in Algeria in 2006. Among the provisions which are included in this convention as well as this law and that are worthy of study and analysis are those allocated to the international cooperation. Therefore, this study aims to highlight the value of these provisions at the level of the text of the convention and its implications on the internal text of the law on the prevention and control of corruption.
