المسؤولية الجزائية للطبيب الناشئة عن الخطأ Criminal Liability Of The Doctor Arising From The Error

Résumé: نبحث في هذه المداخلة المسؤولية الجزائية للطبيب الناشئة عن الخطأ والتي تقوم على أركان ثلاثة تتمثل في الخطأ والضرر والعلاقة السببية، فخطأ الطبيب يتمثل في كل إخلال أو تقصير من جانبه حال أداء مهنته، أو إهماله، أو عدم قيامه بالالتزامات الخاصة التي تفرضها عليه الأصول الفنية لهذه المهنة الإنسانية. من خلال دراسة هذا الموضوع توصلنا لنتائج من بينها: لا يمكن أن تقوم الجريمة من جانب الطبيب أو مساعديه إلا بإثبات وجود العلاقة السببية بين الخطأ المرتكب من طرفهما وبين الضرر اللاحق بالضحية. كذلك يعاقب الطبيب إذا ما ارتكب جرائم القتل الخطأ والجرح الخطأ على أساس نصوص وردت في قانون العقوبات. We discuss in this intervention the penal responsibility of the doctor arising from the error, which is based on three pillars represented in the error, the damage and the causal relationship. The doctor’s error is represented in every breach or negligence on his part in the performance of his profession, or his neglect, or his failure to perform the special obligations imposed on him by the technical assets of these humanitarian profession. By studying this topic, we reached conclusions, including: The crime on the part of the doctor or his assistants can only be established by proving the existence of a causal relationship between the error committed by them and the harm caused to the victim. The doctor shall also be punished if, as a result of his fault, he commits wrongful killing and wrongful wounding on the basis of provisions contained in the Penal Code.
