حق الضحية في إنهاء المتابعة الجزائية

Résumé: منح القانون الجزائري للضحية الحق في إنهاء المتابعة الجزائية عبر طرق محددة وهي الحق في الصفح والوساطة والمصالحة الجزائية، لهذا فقد أصبحت الضحية لها دور في إنهاء المتابعة الجزائية ولم تعد ذلك الشخص المنسي في القانون، ذلك لكونها الأقدر في تقرير ما هو ملائم من إجراءات في بعض الجرائم المحددة حصرا والتي من شانها تسهيل سبل اقتضاء حقها بعيدا عن العقوبات والشكليات. إن هذه الحقوق لا تنتج أثارها إلا إذا تمت صحيحة وفقا للشروط الموضوعية والإجرائية التي حددها القانون فإذا تمت هذه الإجراءات صحيحة فلا شك إن أهم اثر يترتب عليها هو انقضاء الدعوى العمومية. الكلمات المفتاحية الضحية – الصفح – الوساطة – المصالحة Abstract : Algerian law grants the victim the right to end the criminal prosecution through specific methods, which is the right to penal forgiveness, mediation and reconciliation. Therefore, the victim has become a role in ending the criminal prosecution and is no longer that forgotten person in the law, because it is the most capable of deciding the appropriate procedures in some cases. Exclusively specified crimes that facilitate the means to obtain their right away from penalties and formalities. These rights do not produce their effects unless they are carried out correctly in accordance with the substantive and procedural conditions set by law if these procedures are carried out correctly, there is no doubt that the most important effect of them is the expiration of the public case.
