الحجز التنفيذي على العقارات المشهرة

Résumé: ملخص: لقد أولى المشرع أهمية كبرى للحجز التنفيذي على العقارات والحقوق العينية العقارية لما يترتب عن هذا النوع من مخاطر على حق الملكية المكرس دستوريا، وكذا على الأمن العام لهذا تم إدخال أحكام جديدة على الحجز العقاري الذي يشمل العقار بطبيعته والعقار بالتخصيص والحقوق العينية العقارية وملحقاتها بهدف حماية حقوق الدائن من جهة وتجنيب المدين تعسف دائنه من جهة ثانية. وقد اعتمد المشرع في صياغتها قدر الإمكان على تبسيط الإجراءات وتوضيحها أكثر وإضافة نصوص جديدة لسد النقص والفراغ الذي يكتنف الحجز العقاري وذلك تماشيا مع ما استقر عليه العمل القضائي ومع ما أخذت به التشريعات المقارنة، لتبسيط إجراءات الحجز ومنح الدائن فرصة تجنب آثارها عليه. كلمات مفتاحية: الدائن الحاجز، المدين المحجوز عليه، الاعتراضات، المزاد العلني. Abstract: Algerian legislator has attached great importance to the executive distraint of real estate and rights in rem due to the consequences of jeopardizing constitutional right of ownership, as well as public security. That is why new provisions have been introduced on real estate distraint, which include real estate by its nature, property with allocation, real rights and their attachments in drafting them to protect the rights of the criditor on the one and to spire the debtor on the other hand. The legislator has relied as much as possible on simplifying and clarifying procedures further, and adding new texts to fill the deficiency relating to real estate distraint, in line with judicial decisions and comparative legislation. To simplify the seizure procedures and give the creditor the opportunity to avoid its effects on him.
