نظام عقد امتياز استغلال العقار الصناعي كأرضية للاستثمار الأجنبي

Résumé: ملخص: بالنظر إلى أهمية الاستثمار لا سيما الأجنبي منه في خلق ديناميكية تنموية في جميع القطاعات ، و في إطار سياسته لتشجيع و تطوير الاستثمار الأجنبي في البلاد اعتمد المشرع الجزائري جملة من الآليات و التحفيزات التي أقرها ضمن القوانين المتعاقبة ذات الصلة بمجال الاستثمار ، و من جملة الآليات التي أقرها هو نظام امتياز استغلال العقار الصناعي كمحاولة منه للحد من إشكالية محدودية و ارتفاع تكاليف الأراضي القابلة لاحتضان المشاريع الاستثمارية، هذه الإشكالية تعد من بين أهم الأسباب و الدوافع التي تحول دون تشجيع و تكريس الاستثمار الأجنبي ، هذا و قد تم النص على هذا النظام من خلال القانون 06-11 قبل أن يلغى بموجب الأمر 08-04 المحدد لشروط و كيفيات منح الامتياز على الأراضي التابعة للأملاك الخاصة للدولة و الموجهة لانجاز مشاريع استثمارية ليقوم بعد ذلك بتعديل هذا الأخير من خلال قانون المالية التكميلي لسنة 2011 ، و في هذا الإطار تندرج إشكالية هذه المداخلة حول : مدى فعالية نظام امتياز استغلال العقار الصناعي في تكريس و تنشيط الاستثمار الأجنبي في الجزائر ؟ Abstract : Given the importance of investment, especially foreign investment, in creating a developmental dynamic in all sectors, and within the framework of its policy to encourage and develop foreign investment in the country, the Algerian legislature adopted a set of mechanisms and incentives that it approved within the successive laws related to the field of investment, and among the mechanisms that It was approved by the system of concessions for the exploitation of industrial real estate as an attempt to reduce the problem of limited and high costs of land capable of incubating investment projects. This problem is among the most important reasons and motives that prevent the encouragement and devotion of foreign investment, and this has been stipulated in this system through Law 11-06 before it was canceled according to Order 08-04 specifying the conditions and methods of granting concessions on lands belonging to private property of the state and directed to the completion of investment projects, to then amend the latter through the supplementary finance law of 2011, and in this context this problem falls The intervention on: How effective is the concession system for the exploitation of industrial real estate in devoting and stimulating foreign investment in Algeria?
