صيغ استغلال العقارات الوقفية الموجهة لانجاز مشاريع استثمارية

Résumé: ملخص: يهدف هذا المقال لدراسة عقود استغلال الأملاك الوقفية الموجهة لإنجاز المشاريع الاستثمارية سواء من الجانب الشرعي أو القانوني حيث أولى المشرع الجزائري اهتماما بالغا بالاستثمار في العقار مبنيا كان أو غير مبني بالأخص العقارات. الموقوفة وقفا عاما والموجهة لإنجاز مشاريع استثمارية ، نظرا للدور البارز الذي تلعبه على مختلف الأصعدة التنموية اجتماعيا واقتصاديا ، فعمل على تفعيل دورها في المحيط العمراني الحضري محددا لها جملة من الشروط والضوابط منها ما يرتبط بالمستفيد ومنها ما يرتبط بالعقار الوقفي محل التعاقد وتعتبر عقود استغلال العقار الوقفي الموجه لإنجاز مشاريع استثمارية فتحا لمجال التنافس في ميدان الأوقاف خاصة مع الصيغ التي استحدثها المشرع لاستغلال العقارات الوقفية Abstract: This article aims to study contracts for the exploitation of endowment real estate intended for the implementation of investment projects, whether from a legal or lawful point of view. to activate its role in the urban environment, by specifying a certain number of conditions and controls, including those related to the beneficiary, and others related to the real estate endowment object of the contract. The contracts for the exploitation of endowment real estate oriented towards the realization of investment projects are considered as an opening to competition in the field of endowments, in particular with the formulas developed by the legislator for the exploitation of endowment real estate.
