الحماية القانونية للأشخاص ذوي الإعاقة أثناء النزاعات المسلحة

Résumé: ملخص: باختلاف المجتمعات و الشعوب تقدما وتخلفا ،يبقى الأشخاص ذوو الإعاقة من أكثر الفئات هشاشة ،وأكثرها هشاشة وفقرا في الدول المتخلفة في أوقات السلم ،فإذا ما شب نزاع مسلح ،فلن يوجد وصف لما يمكن أن يحدث فالقتل أكيد ،فالتحديات التي تواجهها هاته الفئة تبرز ماهية الحقوق الإنسانية وتطبيقها سواء في السلم أو في أوقات النزاع المسلح ،وسعى المجتمع الدولي لضمان حقوق هذه الفئة في اتفاقية الأشخاص ذوي الإعاقة ،لكن حمايتهم أثناء النزاعات المسلحة أمر آخر ،ولأجل هذا يهدف البحث باتباع المنهج الوصفي التطرق إلى النصوص القانونية الدولية التي توفر الحماية لذوي الاحتياجات الخاصة أثناء النزاعات المسلحة والآليات الكفيلة بتحقيقها على أرض الواقع ،وتحليل أهمها ،والاستعانة بالمنهج التاريخي لتحديد أوجه الحماية للأشخاص ذوي الإعاقة في اتفاقيات حقوق الإنسان ،واتفاقيات القانون الإنساني الدولي. Abstract: With different societies and peoples, progress and underdevelopment, persons with disabilities remain among the most vulnerable groups, and the most vulnerable and poor in underdeveloped countries in times of peace. humanity and its application, both in peace and in times of armed conflict, The international community has sought to guarantee the rights of this group in the Convention on Persons with Disabilities, but protecting them during armed conflicts is another matter, and for this purpose, the research aims by following the descriptive approach to address the international legal texts that provide protection for people with special needs during armed conflicts and the mechanisms to achieve them on the ground, and to analyze The most important of which is the use of the historical approach to determine the aspects of protection for persons with disabilities in human rights conventions and international humanitarian law conventions.
