الآلية القانونية لحماية المؤسسات الاقتصادية في حالة الصعوبات المالية - دراسة مقارنة -

Résumé: للمؤسسات التجارية دور فعال في تنمية الاقتصاد الوطني لذلك استلزم الأمر حمايتها من خطر الإفلاس باعتبار يشكل تهديدا على استمراريتها ، لهذا وجب الكشف المبكر عن الصعوبات المالية التي قد تواجهها، كما منحت للمؤسسات إمكانية مد يد العون لها وإنقاذها بإعطائها حق الحصول على الصلح وتسوية نزاعاتها مع جماعة الدائنين، وهذا لخلق مؤسسات اقتصادية و تجارية أقوى وأقدر على المنافسة و زيادة الأرباح وتقوية الاقتصاد الوطني. The commercial institutions have an active role in the development of the national economy. Therefore, it is necessary to protect them from the risk of bankruptcy as a threat to their continuity. Therefore, the financial difficulties that may be faced must be revealed early. The institutions have the ability to help them and save them by giving them the right to seek reconciliation and settle disputes with them. The group of creditors, and this to create stronger and more competitive economic and trade institutions, increase profits and strengthen the national economy.
