التشريعات القانونية كمحفز للنشاط الاقتصادي ( دراسة تحليلية لقانون الاستثمار 22-18 في الجزائر )

Résumé: تعالج الدراسة دور الإطار التشريعي ( النظم والقوانين) في تأطير النشاط الاقتصادي والدفع باتجاه تحقيق أهداف السّياسات الاقتصادية، ذلك أن كلّ الممارسات للأنشطة الاقتصادية تخضع لمتغيرات البيئة السياسية، الاجتماعية والاقتصادية، والتي تعدّ التشريعات والقوانين إحدى مكوّناتها الأساسية. ومن خلال التركيز على قانون الاستثمار ( 22-18) في الجزائر، تسعى الدّراسة إلى تفكيك حدود واتجاهات تلك العلاقة، ومدى ارتباط التطور في الإطار التشريعي المنظم للنشاط الاستثماري في الجزائر ببنية المحيط الاقتصادي والسياسي، وهل يعكس قانون الاستثمار الجديد وجود إدارة حقيقية لبعث أنشطة الاستثمار وخلق الديناميكية المطلوبة للتنمية الشاملة. This study deals with the role of legislation (regulations and laws) in framing economic activity and achieving the goals of economic policies. So that, All the practices of economic activities are subject to the political, economic, and social environment of whish which legislation is a key component. Taking the Algerian investment law 18-22 as case study. This research aims to deconstruct the relationship between legislations and economic activity, and to what extent the legislation development relate to economic and political structure.
