نظرة حول جديد قانون الاستثمار لسنة 2022

Résumé: ملخص: لقد عمدت الجزائر منذ الإصلاحات القانونية في نهاية الثمانينات إلى إصدار العديد من النصوص القانونية ذات الصلة بالاستثمار أولها المرسوم التشريعي رقم 93-12 مرورا بالأمر رقم 01-03 والقانون رقم 16-09 وصولا إلى آخر قانون وهو القانون رقم 22-18. وفي كل مرة تتضمن هذه القوانين أحكام توحي بأنها تهدف إلى تطوير وترقية الاستثمار في الجزائر مراعية خصوصية التزامات الجزائر الدولية بالدرجة الأولى، الأمر الذي لم يسمح للقوانين الثلاث الأولى بأن تحقق الأهداف المسطرة بالنظر إلى عدم تلاؤمها مع الواقع الاقتصادي الجزائري. ذلك ما جعل السلطات في الجزائر بواسطة السلطة التشريعية تصدر القانون الأخير رقم 22-18 من حيث محاولة عدم الوقوع في نفس الصعوبات التي اكتنفت القوانين السابقة عنه وهو ما يفسر تضمينه عدة أحكام وقواعد. الكلمات المفتاحية: الاستثمار، القوانين الجزائرية، الأحكام والقواعد المستجدة، الجانب المؤسساتي، مجالات الاستثمار، المزايا والتحفيزات. Abstract : Since the legal reforms of the late 1980s, Algeria has promulgated numerous legal texts relating to investment, the first of which is Decree-Law No. 93-12, followed by Ordinance No. 01-03, Law No. 16-09, and the last law, which is Law No. 22-18.Each time, these laws include provisions which imply that they aim to develop and promote investment in Algeria, taking into account in the first place the specificity of Algeria's international obligations, which have not allowed first three laws to achieve the objectives set given their incompatibility with the Algerian economic reality. This is what prompted the Algerian authorities, through the legislative authority, to promulgate the latest law n°22-18 in terms of trying not to fall into the same difficulties that surrounded the previous laws on this subject, which explains its inclusion of several provisions and rules.
