موقف عبد الرزاق السنهوري من تقنين الفقه الإسلامي

Résumé: لما كان السنهوري من أهم الشخصيات البارزة والمؤثرة في المجال التشريعي في مصر ، والذي أسند إليه وضع القانون المدني المصري الجديد وغيره من القوانين في مصر وغيرها من الدول العربية لجأ إلى القوانين الغربية كأصل عام واستمد منها نصوص القانون المدني المصري ، غير أن استمد أحيانا بعض النصوص القانونية من الفقه الإسلامي وخصوصا من مجلة الأحكام العدلية و من مرشد الحيران لقدري باشا ، والسنهوري في استمداده لأكثر النصوص القانونية للقانون المدني المصري من القوانين الغربية ليس تنكرا للفقه الإسلامي كما ادعاه البعض ولا لعدم قدرته على مواكبة العصر ، أو عدم صلاحيته للتطبيق ولكن في رأي السنهوري لا بد من دراسته الفقه الإسلامي دراسة وافية مقارنة بالقوانين الغربية لسد مكامن النقص فيه وخصوصا أن النوازل في هذا العصر كثيرة جدا ولا بد فتح باب الاجتهاد وتشجيعه حتى يصبح الفقه الإسلامي فقها عصريا يفوق في أحكامه ما وصلت إليه القوانين الغربية اليوم ، وحتى يصبح الفقه الإسلامي هو القانون المدني العربي الموحد .
